The following Terms of Use are entered into by and between You and Dr. Mandy Cisler. (“Company”, “we”, or “us”).

The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your access to and use of drmandycisler.com, including any content, functionality and services offered on or through drmandycisler.com (the “Website”), whether as a guest or a registered user.

BINDING EFFECT. This is a binding agreement. Please read the Terms of Use carefully before you start to use the Website. By using the Website, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms of Use including the agreements incorporated by reference herein, you must not access or use the Website.

CHANGES TO THE TERMS OF USE
We may revise and update these Terms of Use from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter. Your continued use of the Website following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

PRIVACY POLICY. The Website respects your privacy and permits you to control the treatment of your personal information. The Website privacy policy is expressly incorporated into this Agreement by this reference.

DISCLAIMER: Your use of the Website is also subject to the Company’s Disclaimer. Please review our Disclaimer, which also governs the Website and informs users of various limitations regarding the information provided on the Website. Your agreement to the Disclaimer is hereby incorporated into these Terms of Use. Although Dr. Mandy Cisler is a licensed therapist and coach, she is not your therapist or coach. The Website is not providing therapy or mental health services or advice. The Website is for educational purposes only. The results stated are my personal results. Please understand my results are not typical. I’m not implying you’ll duplicate them (or do anything for that matter). The average person who buys any “how to” information gets little to no results. I’m using these results for example purposes only. Your results will vary and depend on many factors including but not limited to your background, experience, and work ethic. All self-improvement work entails massive and consistent effort and action. If you’re not willing to accept that, please DO NOT register for free or paid trainings, programs, or courses.

GOVERNING LAW. These Terms shall be construed in accordance with and governed by the laws of the United States and the State of Nevada, without reference to their rules regarding conflicts of law. You hereby irrevocably consent to the exclusive jurisdiction of the state or federal courts in Reno, Nevada in all disputes arising out of or related to the use of the site.

AGE. The site is intended only for users aged 18 or older. Individuals under the age of 18 are strictly prohibited from using the site and the accounts for any such person shall be terminated upon discovery.

USER CONTENT. You grant The Website a license to use the materials you post to the Site or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content (“User Content”) to the Site or Service, you are granting The Website, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the Internet business of The Website, its affiliates, officers, directors, employees, consultants, agents, and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content. You will not be compensated for any User Content. You agree that The Website may publish or otherwise disclose your name in connection with your User Content. By posting User Content on the Site or Service, you warrant and represent that you own the rights to the User Content or are otherwise authorized to post, distribute, display, perform, transmit, or otherwise distribute User Content.

COMPLIANCE WITH INTELLECTUAL PROPERTY LAWS. When accessing the Site or using the Service, you agree to obey the law and to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. The burden of proving that any Content does not violate any laws or third party rights rests solely with you.

You agree not to upload, download, display, perform, transmit, or otherwise distribute any Content that (a) is libelous, defamatory, obscene, pornographic, abusive, or threatening; (b) advocates or encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or foreign law or regulation; or (c) advertises or otherwise solicits funds or is a solicitation for goods or services. The Website reserves the right to terminate your receipt, transmission, or other distribution of any such material using the Service, and, if applicable, to delete any such material from its servers. The Website intends to cooperate fully with any law enforcement officials or agencies in the investigation of any violation of these Terms of Use or of any applicable laws.

ALLEGED VIOLATIONS. The Website reserves the right to terminate your use of the Service and/or the Site. To ensure that The Website provides a high quality experience for you and for other users of the Site and the Service, you agree that The Website or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized uses of the Site or the Service. The Website does not intend to disclose the existence or occurrence of such an investigation unless required by law, but The Website reserves the right to terminate your account or your access to the Site immediately, with or without notice to you, and without liability to you, if The Website believes that you have violated any of the Terms of Use, furnished The Website with false or misleading information, or interfered with use of the Site or the Service by others.

NO WARRANTIES. THE WEBSITE HEREBY DISCLAIMS ALL WARRANTIES. THE WEBSITE IS MAKING THE SITE AVAILABLE “AS IS” WITHOUT WARRANTY OF ANY KIND. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. LIMITED LIABILITY. THE WEBSITE’S LIABILITY TO YOU IS LIMITED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE WEBSITE BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, EMOTIONAL, PSYCHOLOGICAL, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU BY THE WEBSITE. The Website works with a number of partners and affiliates whose Internet sites may be linked with the Site. Because neither The Website nor the Site has control over the content and performance of these partner and affiliate sites, The Website makes no guarantees about the accuracy, currency, content, or quality of the information provided by such sites, and The Website assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on those sites. Similarly, from time to time in connection with your use of the Site, you may have access to content items (including, but not limited to, websites) that are owned by third parties. You acknowledge and agree that The Website makes no guarantees about, and assumes no responsibility for, the accuracy, currency, content, or quality of this third party content, and that, unless expressly provided otherwise, these Terms of Use shall govern your use of any and all third party content. The Website may also link to affiliated services such as Payhip for digital product purchases. These services operate independently and have their own terms and privacy policies.

PROHIBITED USES. The Website imposes certain restrictions on your permissible use of the Site and the Service. You are prohibited from violating or attempting to violate any security features of the Site or Service, including, without limitation, (a) accessing content or data not intended for you, or logging onto a server or account that you are not authorized to access...

FEES, REFUNDS, AND CANCELLATIONS.

Third-Party Platform for Digital Sales
We use Payhip (https://payhip.com/drmandycisler), a third-party platform, to host and deliver certain digital products and services available for purchase. All purchases made through Payhip are subject to their terms and conditions, as well as their privacy and refund policies. By purchasing through Payhip, you agree to abide by Payhip’s terms, in addition to ours. Please review Payhip’s Terms and Privacy Policy for details about how your purchase data and access to content are handled.

The Website 30 Day Satisfaction Guarantee: In the event that you decide your purchase was not the right decision for you, within 30 days of enrollment, contact our support team at [email protected] and let us know you’d like a refund by the 30th day at 11:59 PST. In order to receive a refund, you must include your course work with your request for a refund. If you request a refund and do not include your coursework by the 30th day, you will not be granted a refund. All refunds are discretionary as determined by the Website. We want you to be satisfied with your purchase but we also want you to give your best effort to apply all of the strategies in the program(s). You must also demonstrate that you have attempted to implement the program without success. To meet this requirement, the work that you need to submit with your request for a refund for the Healing Framework: Mapping Your Relationship Blueprint Course includes ALL of the following items: Completed Attachment Anxiety Assessment, Completed Family of Origin Genogram, Completed Family of Origin Worksheet, Completed Self-Regulation Worksheets. Tell us why this course was not a good fit for you, including what did you expect that you did not get once inside the program? We will NOT provide refunds more than 30 days following the date of purchase. After day 30, all payments are non-refundable and you are responsible for full payment of the fees for the program regardless if you complete the program. Please note: If you opted for a payment plan and you do not request a refund within 30 days, or do not attach the required complete coursework as outlined above, you are required by law to complete the remaining payments of your payment plan. If you we attempt to collect a payment and a payment fails, you will be issued an invoice for the entire remaining amount that will be due within 30 days. If the invoice is not paid, we have the right to engage a collections agency. Additionally, if at any time you remove your credit card information and do not replace it with updated information within 24 hours, you will be removed from the Kajabi group and issued an invoice for the entire remaining amount that will be due within 30 days. If the invoice is not paid, we have the right to engage a collections agency.

Recurring Payments. If you have signed up for a payment plan, you hereby authorize our continued access to your financial information stored by our third party financial processing company referenced in this Agreement until your payment plan is complete, as set forth in your acceptance of the purchase terms upon checkout.

Late Payments. If payments are not made on time, you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Chargebacks. You agree to make every attempt to request a refund prior to attempting a chargeback with your financial institution. In the event of a chargeback attempt, you expressly agree to forfeit any and all of our bonuses, affiliate bonuses or other materials afforded to you in exchange for your original purchase of our Course. We reserve the right to present proof of your access and these Terms to the financial institution investigating the dispute.

MISCELLANEOUS: The Company reserves the right, in its sole discretion, to terminate a customers access to its Kajabi groups or payhip courses.

AMENDMENTS. The Company reserves the right, in its sole discretion, to change the Terms under which the Website is offered. The most current version of the Terms will supersede all previous versions. The Company encourages you to periodically review the Terms to stay informed of our updates.

Should a court of competent jurisdiction rule this Amendment provision invalid, then this Amendment clause shall be terminated as part of this agreement with the agreement between us reverting to the previous set of terms applicable to the website. All amendments to the Terms shall be forward looking.
